Terms and Conditions

These Terms and Conditions govern purchases from SMJ Sports Cards & Collectibles (“SMJ,” “we,” “us,” or “our”) through smjsportscards.com. By using the site or placing an order, you agree to these Terms.

1. Eligibility and accounts

You must be legally able to enter a binding contract. You are responsible for accurate account and order information, safeguarding your login, and all activity under your account. We may refuse service, cancel orders, or restrict accounts for fraud, abuse, chargeback misuse, or violations of these Terms.

2. Products and orders

We sell sports-card singles, sealed products, break spots, accessories, and related collectibles. Product images and descriptions are provided in good faith, but colors and minor packaging details may vary. An order is accepted only when we confirm it. We may correct errors, limit quantities, or cancel and refund an order if inventory, pricing, payment, or fraud-screening issues arise.

3. Sports-card breaks

A break is the opening of sealed trading-card products whose cards are allocated to customers according to the method stated on the break listing. Methods may include pick-your-team, random team, random division, or another clearly described format. Purchasing a spot does not guarantee any particular card, player, team, insert, autograph, memorabilia card, or monetary value. A spot may receive few cards or no cards.

For random formats, assignments are made using the process identified by SMJ and are final once randomization begins. Cards featuring multiple teams, unassigned subjects, points, redemptions, or other ambiguous items will be allocated under the rules stated in the listing; if the listing is silent, SMJ will use a fair random allocation among eligible spots. Reasonable determinations by SMJ are final.

Break schedules are estimates and may change because of sell-through, product delivery, platform availability, weather, or other operational issues. We may postpone a break or cancel it and refund unfulfilled spots. Breaks may be livestreamed and recorded, and participation authorizes display of the customer’s first name, initials, username, team, division, or spot assignment as reasonably necessary to conduct the break.

4. Base and common cards

Each break listing will state whether veteran base/common cards are included. When they are included and an opt-out is offered, the customer may decline those cards for that break during purchase. Unless the listing expressly says otherwise, an opt-out does not exclude rookies, inserts, parallels, numbered cards, short prints, autographs, memorabilia cards, case hits, or other non-base hits. Opting out does not provide a refund or shipping credit. The selection made for the applicable break item at checkout controls.

5. Break cancellations and returns

Break spots may be cancelled only before the break’s randomization, team assignment, or opening begins, and only if the listing permits cancellation. Once that activity begins, break sales are final except where required by law or where SMJ cancels the break. Cards received through a completed break cannot be returned based on card selection, condition, quantity, or value.

6. Singles, sealed products, and accessories

Condition assessments are opinions based on reasonable visual inspection and are not guarantees of a grading-company result. Raw cards may have manufacturing or handling imperfections. Graded-card descriptions defer to the slab and certification shown. Sealed-product odds, collation, redemptions, and contents are controlled by the manufacturer; SMJ does not guarantee results or manufacturer support.

7. Prices, payment, and taxes

Prices are shown in U.S. dollars unless stated otherwise. Payment is due at checkout and is processed through Shopify and its payment providers. Applicable taxes and shipping charges are shown before purchase. You authorize us and our providers to charge the selected payment method. Unauthorized chargebacks or payment fraud may result in account restrictions and collection of lawful costs.

8. Shipping and delivery

Customers must provide a complete and accurate delivery address. Shipping charges may reflect product weight, packaging, service level, and the number of break spots in an order. Multiple orders or break shipments may be combined when practical, but consolidation is not guaranteed. Delivery dates are estimates. Risk of loss transfers as permitted by applicable law. Contact us promptly about missing, damaged, or incorrect shipments and retain all packaging so we can investigate with the carrier.

9. Store content and acceptable use

The site, branding, photographs, graphics, text, videos, and software are owned by or licensed to SMJ and may not be copied, sold, scraped, or commercially reused without permission. You may not interfere with the site, attempt unauthorized access, introduce malicious code, automate abusive purchases, manipulate break assignments, or use the service unlawfully.

10. Third-party services

Our store uses Shopify and may rely on payment processors, shipping carriers, analytics providers, livestream platforms, inventory services, and other third parties. Their services may be governed by separate terms and privacy policies. Links to third-party sites do not imply that SMJ controls or endorses them.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, the site and services are provided “as is” and “as available,” without warranties beyond those expressly stated. Collectibles are speculative purchases; SMJ does not guarantee future value, resale value, grading outcome, or investment performance. To the maximum extent permitted by law, SMJ will not be liable for indirect, incidental, special, consequential, or punitive damages. SMJ’s aggregate liability relating to a claim will not exceed the amount paid for the product or service giving rise to that claim. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.

12. Indemnification

To the extent permitted by law, you agree to indemnify SMJ against claims, losses, and reasonable expenses arising from your unlawful use of the site, violation of these Terms, or infringement of another person’s rights.

13. Governing law and disputes

These Terms are governed by the laws of North Carolina, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes will be brought in the state or federal courts serving Guilford County, North Carolina. Before filing a claim, please contact us so we can attempt to resolve it informally.

14. Changes and severability

We may update these Terms by posting a revised version and effective date. Changes apply prospectively. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
